Procedural Posture

Miscellaneous Application / Judgment

  1. 1 Whether the Land Disputes Tribunal had jurisdiction to determine disputes relating to ownership of registered land.
  2. 2 Whether the Tribunal's award regarding subdivision of the suit property was valid.

Ratio Decidendi

The court found that the dispute before the Tribunal concerned ownership and registration of land under the Registered Land Act, Cap 300, which is outside the jurisdiction of the Land Disputes Tribunal as per the repealed Land Disputes Tribunal Act. The Tribunal could not determine the parties' rights to the suit property without addressing title, which it was not empowered to do. Consequently, the Tribunal's decision was made without jurisdiction and is therefore null and void. The appeal was allowed on this basis.

Court Disposition

Appeal allowed. Tribunal award set aside for want of jurisdiction.

Orders

  • The appeal is allowed as prayed.
  • The award of the Githunguri Land Disputes Tribunal is set aside for want of jurisdiction.
