Ratio Decidendi

The court found that the Plaintiff lawfully acquired plot no. 1393 through purchase of shares and a consent order in a previous suit. The surveyor’s report confirmed the Plaintiff’s occupation of plot no. 1393 and that the 2nd Defendant’s plots were different. The 2nd Defendant’s construction of a wall around plot no. 1393 constituted trespass, depriving the Plaintiff of access and enjoyment of his property. The Plaintiff was entitled to damages for trespass, and the court awarded Kshs. 300,000 as general damages. The Plaintiff was also entitled to the injunctive and declaratory reliefs sought, and the costs of the suit.

Judgment for the Plaintiff.
