Legal Issues
- 1 Whether the application meets the threshold for joinder of charges under criminal procedure.
- 2 Whether offences committed in different jurisdictions with different complainants and subject matters can be joined.
Ratio Decidendi
The court found that the application for joinder of charges did not meet the legal threshold because the two offences were committed in different jurisdictions, involved different complainants, and concerned different subject matters. The only similarity was the nature of the offence, which by itself is insufficient to warrant joinder. The court emphasized that joinder is only appropriate where offences are connected by facts, complainants, or subject matter, and that joining cases solely on the basis of similar offences would be contrary to the principles of fair trial and proper administration of justice. Accordingly, the application was dismissed.
Court Disposition
application dismissed
Orders
- The application for joinder of charges is dismissed.
- There shall be no orders as to costs.

MISC. CR. APP. NO.392 OF 2018

RULING
The application does not meet the threshold for guidelines on joinder of charges. Clearly, the two offences were committed in two different jurisdictions. The Complainants are different. The subject matters of the cases are different. The only similarity in the cases is the offence itself which alone cannot occasion the joinder of the cases. I accordingly dismiss the application with no orders of coasts.
