The Certificate of Delay relied upon by the 1st Respondent was irregular and did not accurately reflect the true position regarding the readiness of proceedings and judgment, as the Claimant had collected his copies much earlier. The court held that there was no satisfactory explanation for the delay and that the 1st Respondent only acted after execution proceedings commenced.
