Ratio Decidendi

The court found that the withdrawal of CMCC No. 1119 of 2005 by the plaintiff in person was invalid because the plaintiff was still represented by an advocate and had not filed a notice of change of representation. Therefore, CMCC No. 1119 of 2005 remained valid and had not been properly withdrawn. The court further held that CMCC No. 7732 of 2006 was properly struck out for being res subjudice and could not be revived by the trial court. As a result, the application for leave to appeal out of time and for stay of proceedings was dismissed as it would serve no purpose. The only valid suit between the parties remained CMCC No. 1119 of 2005.
