Ratio Decidendi

The court found that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Section 8 of the defunct Land Disputes Tribunals Act only permits appeals to the court from decisions of the Appeals Committee. The absence of such a decision meant that there was no valid appeal before the court. The court emphasized that jurisdiction is foundational and must be addressed immediately upon its discovery.
