Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the claimant's employment on account of redundancy was unfair.
  2. 2 Whether there was a breach of contract regarding withheld salaries and terminal dues.
  3. 3 What remedies, if any, are appropriate for the claimant.

Ratio Decidendi

The court found that the respondent failed to comply with the mandatory procedural requirements for redundancy under section 40(1) of the Employment Act, 2007, as there was no evidence that the required 30-day notice was served upon the trade union and local labour officer. Additionally, the respondent did not substantiate the validity of the redundancy, as it failed to rebut the claimant's assertion that he was occasionally assigned other vehicles and did not provide evidence regarding the number of drivers or vehicles in use. Consequently, the termination was both procedurally and substantively unfair. The claim for withheld salaries and terminal dues was dismissed for lack of evidence.

Court Disposition

Claim partly allowed. Termination declared unfair. Compensation awarded. Costs denied.

Orders
