The period of delay, approximately three months, was not inordinate. The grounds of appeal disclosed an arguable case with a possibility of success, and the respondent would not suffer prejudice as he had not participated in either the lower court or current proceedings. The court, therefore, exercised its discretion to grant leave to appeal out of time, deem the draft memorandum of appeal as duly filed, and issued consequential directions for service and mention.
