Ratio Decidendi

The trial court erred by failing to consider the period the appellant spent in custody prior to sentencing, as required by section 333(2) of the Criminal Procedure Code and the Kenya Judiciary Sentencing Guidelines, 2016. Although the trial court stated it considered mitigation, it imposed the maximum sentence without factoring in that the appellant was a first offender and had been in custody for a year. This omission rendered the sentence excessive. The appellate court therefore set aside the 7-year sentence and substituted it with a 4-year sentence to run from the date of the original sentencing.
