Ratio Decidendi

The Tribunal found that the Landlord's Notice to Terminate did not comply with the statutory requirement of providing at least two calendar months' notice as stipulated under Section 4(4) of Cap 301. The evidence showed that the Tenant was served with the Notice on 24th October 2023, with a termination date of 1st December 2023, giving less than two calendar months. The Tribunal held that the notice period was insufficient and therefore the Notice was invalid. Consequently, the Landlord's application for eviction and related orders failed for want of proper notice.
