The court held that the 1st defendant was required by Order 8 Rule 6 of the Civil Procedure Rules to file its amended defence and counterclaim within 14 days of the order granting leave, as no specific period was set. The 1st defendant failed to do so and did not obtain further leave to file out of time. The court found that section 100 of the Civil Procedure Act does not empower it to allow the filing of amended pleadings out of time, and Article 159(2) of the Constitution cannot be used to circumvent mandatory procedural requirements.
