Ratio Decidendi

The High Court found that the Maseno Law Courts did not have the appropriate geographical jurisdiction to hear the criminal case in question. In the interest of justice and to ensure that the matter is heard by a court with proper jurisdiction, the High Court exercised its powers under Section 81 of the Criminal Procedure Code to withdraw the file from Maseno Law Courts and transfer it to Kombewa Law Courts. The court further directed that the matter be mentioned before the Head of Station at Kombewa Law Court for further directions, and ordered the closure of the file at the High Court.
