Ratio Decidendi

The court held that substitution of a deceased party can only be effected by a person who is a legal representative, as defined by law and formally appointed by a competent court. The mere fact of being a son or even the eldest son of the deceased does not confer the status of legal representative. The court cannot appoint a person who has not been duly appointed as a legal representative to represent the estate of a deceased litigant. In circumstances where no beneficiary seeks letters of administration, the proper course is to cite the beneficiaries in order of priority, and in default, the Public Trustee may be appointed to represent the estate for the purposes of the suit....
