Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant's employment was procedurally fair.
  2. 2 Whether the termination of the Claimant's employment was substantively fair.
  3. 3 Whether the Claimant is entitled to compensation and other terminal dues.

Ratio Decidendi

The Court found that while the Respondent complied with procedural fairness by issuing a show-cause notice and conducting a disciplinary hearing, it failed to provide valid and fair reasons for the Claimant's termination. The Claimant's explanation for the alleged misconduct was not rebutted by any evidence from the Respondent. Consequently, the termination was substantively unfair. The Court awarded the Claimant compensation equivalent to two months' gross wages, pay in lieu of notice, withheld salary, service pay as offered by the Respondent, accrued leave, and wages for February 2015. Costs were denied due to the Claimant's failure to serve submissions on the Respondent.

Court Disposition

Claim partly allowed; termination declared substantively unfair; compensation and terminal dues awarded; costs denied.

Orders
