The court held that the establishment of the Environment and Land Court by the Constitution of 2010 and the Environment and Land Court Act, 2011, did not require the transfer of all pending land cases from Magistrates Courts to the ELC. Transitional provisions in the Constitution and the ELC Act, as well as Practice Directions from the Chief Justice, expressly allow such matters to continue in the courts where they were originally filed, provided those courts had jurisdiction at the time. Since the suit in question was filed in 2006, before the ELC existed, and there was no allegation that the Magistrate's Court lacked jurisdiction at the time, there was no legal basis for transfer.
