Ratio Decidendi

The court found that the properties listed by the Applicant were acquired during the subsistence of the marriage and thus constitute matrimonial property under Section 6 of the Matrimonial Property Act. Although the Applicant claimed a higher contribution, there was insufficient documentary evidence to support this, as both parties relied on trust and informal arrangements. The Respondent's contention that the properties were acquired jointly was accepted. The court held that both parties contributed to the acquisition of the matrimonial properties, both monetarily and non-monetarily, and that the principle of equality in marriage as enshrined in Article 45(3) of the Constitution applies....
