Ratio Decidendi

The court found that although the Marriage Act, 2013 repealed the Matrimonial Causes Act and vests jurisdiction in the Magistrates Court, there are no transitional provisions clarifying the handling of disputes arising from marriages contracted under the old law. The court held that Article 165(3) of the Constitution vests the High Court with unlimited jurisdiction in civil matters, and until legislative clarification or amendment is made, the High Court will continue to hear and determine matters filed under the repealed Matrimonial Causes Act. The preliminary objection was therefore not upheld, and the petitioner was granted leave to amend the petition.
