Ratio Decidendi

The Tribunal found that the appeal was filed outside the 30-day statutory period prescribed by section 25(6) of the Wildlife Conservation and Management Act. The evidence showed the Appellant was notified of the decision on 16th February 2022, but the appeal was not lodged until 8th February 2023. The Tribunal held that limitation of time is a pure point of law that goes to jurisdiction, and once a matter is statute-barred, the Tribunal has no jurisdiction to entertain it. Furthermore, the Tribunal has no statutory power to enlarge the time for filing such appeals. Consequently, the preliminary objection was upheld, and the appeal was struck out as a nullity.
