The Court of Appeal found that the applicant had raised an arguable point on whether orders could be made against a person who was not a party to the original proceedings and whether specific directions were given to her. The court was satisfied that this was not a frivolous grievance. On the second limb, the court accepted that the applicant faced a real risk of incarceration for contempt, which could not be undone if the appeal succeeded, thus rendering the appeal nugatory absent a stay.
