The court noted that the appellant had made efforts to obtain the necessary documents and that the delay was not wholly attributable to the appellant. In the interests of fairness and justice, and to allow the appeal to be heard on its merits, the court exercised its discretion against dismissing the appeal for want of prosecution. The application to dismiss the appeal was therefore declined.
