Procedural Posture

Environment and Land Case / Ruling on Preliminary Objection

  1. 1 Whether the Environment and Land Court has jurisdiction to hear appeals arising from succession matters.
  2. 2 Whether the appeal should be dismissed or transferred to the High Court.

Ratio Decidendi

The Environment and Land Court lacks jurisdiction to hear appeals arising from succession matters, as such jurisdiction is expressly vested in the High Court by Section 50(1) of the Law of Succession Act. The appeal before the court arises from a succession cause, and the issues raised do not transform the matter into a land dispute within the exclusive jurisdiction of the Environment and Land Court. The court cannot transfer a suit filed without jurisdiction to the proper court, as such a suit is a nullity ab initio. Consequently, the preliminary objection is upheld, and the appeal is dismissed for want of jurisdiction.

Court Disposition

preliminary objection upheld; appeal dismissed for want of jurisdiction

Orders

  • The preliminary objection dated 13.09.2023 is upheld.
  • The appeal is dismissed for want of jurisdiction.
