Procedural Posture

Miscellaneous Application / Ruling on Post Appeal Notice of Motion Regarding Interest and Refund Computation

  1. 1 Whether the Employment and Labour Relations Court has jurisdiction to declare that interest is payable to the Respondent by the Claimant following the reduction of the decretal sum by the Court of Appeal.
  2. 2 Whether the Respondent is entitled to interest on the overpaid amount for the period between the trial court judgment and the Court of Appeal judgment.

Ratio Decidendi

The Employment and Labour Relations Court lacks jurisdiction to declare or extrapolate interest payable to the Respondent where the Court of Appeal has already rendered judgment and did not expressly award such interest. The Respondent's application effectively seeks an interpretation or supplementation of the Court of Appeal's orders, which is impermissible for a lower court under the doctrine of hierarchy of courts. Any declaration regarding interest on the overpaid sum must be sought from the Court of Appeal, not the trial court. Accordingly, the application for a declaration of interest is declined for want of jurisdiction.

Court Disposition

Orders

  • The Respondent's application dated 22nd July 2024 is declined with costs to the Claimant.
