Upon discovering the true position, the claimant acted promptly to instruct new counsel and file the present application. In light of the constitutional imperatives of access to justice and the right to be heard, and considering that the respondent would not suffer prejudice that cannot be compensated by costs, the court exercised its discretion to allow the claimant to amend her claim and respond to the counterclaim.
