The court held that once summons have expired without extension, they are 'dead' and cannot be revived or extended. The plaintiff failed to take active steps to prosecute the application or respond to notices to show cause, and as at the time of hearing, there were no valid summons to extend. Therefore, the application for extension of time to re-issue summons was dismissed.
