The banks, as chargees, conducted due diligence and found no encumbrances at the time of registration. The plaintiffs' beneficial interests, even if established, are subordinate to the banks' statutory rights as secured creditors under the Land Registration Act. There is no privity of contract between the plaintiffs and the banks, and any loss suffered by the plaintiffs due to the 1st defendant's breach can be compensated by damages....
