Legal Issues
- 1 Whether the petitioner is entitled to a second resentencing after previous applications were dismissed.
- 2 Whether the transfer of judges constitutes a valid ground for a fresh resentencing petition.
Ratio Decidendi
The court held that the petition for resentencing was an abuse of court process as the applicant had already exhausted his right of appeal and resentencing, both of which had been dismissed. The mere transfer of judges who previously handled the matter does not create a new ground for resentencing. The court emphasized the need to prevent repetitive litigation and uphold the finality of judicial decisions. Accordingly, the petition was found to be devoid of merit and was dismissed.
Court Disposition
Petition dismissed as an abuse of court process.
