The court found that while the respondent had valid grounds to summarily dismiss the claimant for reckless driving and related misconduct, the procedure followed was unfair as the claimant was not given a proper opportunity to defend himself in accordance with Section 41 of the Employment Act 2007. The warnings issued were inconsistent and did not substitute for a fair disciplinary process. The claimant had only worked for 7 months on short-term contracts, and there was no basis for awarding compensation equivalent to 12 months' salary.
