Procedural Posture

Civil Suit / Ruling on Interlocutory Application for Transfer of Suit and Amendment of Defence

  1. 1 Whether the suit should be transferred to the Land and Environmental Law Division of the High Court.
  2. 2 Whether the Commercial Division retains jurisdiction over a claim for refund of purchase consideration paid for land where title could not be passed.

Ratio Decidendi

The court found that the plaintiffs' claim was for the refund of purchase consideration paid to the defendants for land that could not be transferred, and not for the recovery of land or title. The mere fact that the consideration related to land did not convert the dispute into a land matter. The Commercial Division of the High Court retained jurisdiction over such monetary claims. The establishment of the Land and Environmental Law Division did not oust the jurisdiction of the Commercial Division in such matters. The application for transfer was therefore unmeritorious and dismissed with costs.

Court Disposition

application dismissed with costs

Orders

  • The application by the 1st and 2nd defendants for transfer of the suit is dismissed with costs.
