This amounted to constructive dismissal. However, the claim for compensation for the unexpired period of the contract was disallowed as anticipatory earnings are not recoverable. The claim for outstanding leave was also declined due to lack of proof. The court awarded the claimant compensation equivalent to two months' gross salary for unfair termination, with costs and interest.
