Ratio Decidendi

The court found that the Gichugu Land Disputes Tribunal, acting under the repealed Land Disputes Tribunal Act, lacked jurisdiction to determine disputes involving title to or ownership of registered land, or to order its sub-division and transfer. The Tribunal's award, which purported to distribute the appellant's registered land among his children and direct the Executive Officer to sign transfer documents, was therefore made without jurisdiction. As a result, both the Tribunal's award and its adoption as a judgment of the Kerugoya Principal Magistrate’s Court were nullities and of no legal effect. The appeal was allowed, and all orders flowing from the Tribunal's award were set aside.
