The Court of Appeal found that the applicant had satisfied both limbs required for the grant of a stay of execution under Rule 5(2)(b): the appeal was arguable, as it raised the issue of whether the suit land was held in trust for the deceased’s family or whether ownership had already been resolved in favour of the respondents; and the appeal would be rendered nugatory if stay was not granted, as the applicant faced imminent eviction from her only home, with no evidence that she had alternative land. The court held that it was in the interest of justice to preserve the status quo and grant the stay pending the hearing and determination of the appeal.
