Ratio Decidendi

The court determined that although the Environment and Land Court has subject matter jurisdiction over disputes relating to land and environment, the suit properties are located in Kiambu County, where an Environment and Land Court exists at Thika. In line with the constitutional imperative to enhance access to justice and the practical consideration that witnesses and related matters are based in Kiambu, the Nairobi court found it appropriate to transfer the file to the Thika Environment and Land Court. The court declined to make findings on the other issues raised in the application, as jurisdiction must be determined first and is dispositive of the matter at this stage.
