The court found that the matter was not res judicata because the previous suit (HCCC 381 of 2009) was a judicial review application for mandamus and did not determine the merits of ownership or adverse possession. The court further held that the suit land was government land prior to its registration in the name of Stephen Timothy Mwakisha on 25th March 2009, and under Section 41 of the Limitation of Actions Act, no adverse possession could accrue against government land.
