Ratio Decidendi

The court found that, following the amendment to the Magistrate's Court Act and the Environment and Land Court Act effective 2 January 2016, magistrate's courts now have jurisdiction to hear land and environment matters within their pecuniary limits. Therefore, there is no longer a need to transfer the suit to the Environment and Land Court. The court also noted that if the applicant wishes to participate in related suits in the Environment and Land Court, he may apply to be joined in those proceedings. The application to transfer the suit was thus refused on the basis of the new legal position regarding jurisdiction.
