Ratio Decidendi

The court found that the delay in filing the appeal was not inordinate and had been satisfactorily explained by the applicant as resulting from a mis-diarization of the judgment date. Applying the principles for extension of time as set out in Section 79G of the Civil Procedure Act and the Supreme Court's guidance in Nicholas Kiptoo Arap Korir Salat, the court exercised its discretion to allow the application. The court further ordered that the court fees for the filing of the appeal be paid within 14 days, and awarded costs of the application to the respondent.
