The trial court erred in imposing a default sentence of 10 years imprisonment for non-payment of the fine, as the law under section 28(2) of the Penal Code prescribes a maximum default sentence of 12 months for fines exceeding Kshs 50,000. The trial court had three sentencing options under section 32A of the Kenya Information and Communications Act: a fine, imprisonment, or both. In this case, the trial court chose to impose a fine, with a default sentence in case of non-payment. However, the default sentence must comply with the Penal Code, not the minimum term under the Act.
