The County Government of Taita Taveta, through its Governor, lacked the legal authority to classify or gazette the land as community land for the benefit of Mgeno Grazers Integrated CBO. Such power is vested exclusively in the National Land Commission under Article 62(2) and Section 12(1) of the Land Act. The Gazette Notice No. 3052 was therefore issued contrary to the Constitution and statutory provisions.
