Ratio Decidendi

The court found that the applicant filed the appeal 12 days outside the statutory 30-day period prescribed for appeals from subordinate courts to the High Court, without seeking leave for extension of time as required under Section 79G of the Civil Procedure Act. As a result, there was no competent appeal before the court upon which the application for stay of execution could be anchored. The court held that granting a stay in the absence of a valid appeal would be to grant orders in a vacuum, which is impermissible. Consequently, the application for stay of execution was found to be incompetent and was struck out.
