The tribunal held that its jurisdiction under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act is predicated on the existence of a landlord-tenant relationship in respect of a controlled tenancy. Both parties concurred that the tenancy had been terminated and the tenant had vacated the premises as of 18th March 2024. The tribunal found that, following the termination and evacuation, it no longer had jurisdiction to entertain any further issues between the parties. The preliminary objection on jurisdiction was therefore upheld, and the proceedings were struck out.
