Procedural Posture

Criminal Revision / Ruling on Application for Review of Sentence

  1. 1 Whether the High Court at Thika has jurisdiction to review a sentence imposed by the High Court at Nairobi.
  2. 2 Whether the re-sentencing court failed to apply section 333(2) of the Criminal Procedure Code.
  3. 3 Whether the 50-year imprisonment sentence should be reviewed or reduced.

Ratio Decidendi

The High Court at Thika lacks jurisdiction to review or alter a sentence imposed by the High Court at Nairobi, as both are courts of concurrent jurisdiction within a single unitary High Court. The applicant's grievances regarding the length of sentence and application of section 333(2) of the Criminal Procedure Code should have been raised before the re-sentencing court or, if aggrieved, pursued before the Court of Appeal. The application is therefore dismissed for want of jurisdiction, as the court is functus officio and cannot entertain a review of a decision rendered by a court of equal status.
