The court found that the preliminary objection based on res judicata could not stand because the 1st, 2nd, and 3rd respondents were not parties to the previous application (Misc Application No 007 of 2022). The earlier application was dismissed specifically because these respondents were not enjoined, and thus their private rights would have been infringed had the orders been granted. Section 7 of the Civil Procedure Act requires that the parties in both suits be the same for res judicata to apply.
