Ratio Decidendi

The court found that the application for enforcement and eviction was not time-barred because the limitation period commenced from the date the appeal was dismissed, not from the date of the original judgment. The application was filed within the twelve-year limitation period. The court also held that L.R. No. Loc. 14/Kiru/4310 did not form part of the proceedings and therefore no orders could be granted in respect of that parcel. The respondents were entitled to be put into possession of L.R. No. Loc. 14/Kiru/1965/28 and to have the appellant evicted from that parcel. Costs were awarded to the respondents/applicants.
