Cause / Ruling on Objection to Admissibility of Electronic Evidence

  1. 1 Whether emails produced by the claimant are admissible in evidence despite late filing of the certificate of electronic record.
  2. 2 Whether the objection to admissibility of the emails was raised in a timely manner by the respondent.

Ratio Decidendi

The court held that the late filing of the certificate of electronic record did not warrant exclusion of the emails as evidence. The respondent had been served with the bundle containing the emails in October 2023 and did not object until after the claimant had testified and closed his case. The certificate of electronic record does not introduce new evidence but merely establishes the chain of custody for electronic documents. Since the respondent's witness was copied or addressed in the emails and there was no objection to their content, the objection based solely on the timing of the certificate's filing was not sufficient to exclude the evidence. The objection was therefore overruled,...

Court Disposition

objection overruled; emails admitted as evidence

Orders

  • Objection to admissibility of emails is disallowed.
  • Case to proceed as if the certificate of electronic record was filed contemporaneously with the bundle.
