Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside Dismissal and Reinstate Suit

  1. 1 Whether the applicant has demonstrated sufficient reason for non-attendance on June 16, 2021.
  2. 2 Whether the order dismissing the suit for non-attendance should be set aside and the suit reinstated.

Ratio Decidendi

The court found that although the applicant had received the taxation notice by registered post, which was the same method used for serving mention and hearing notices, her status as a litigant in person and the context of virtual hearings during the Covid-19 pandemic could have contributed to her non-attendance. The court considered the importance of determining the true ownership of the land in dispute and the need to hear both parties on merit. Consequently, the court exercised its discretion to set aside the dismissal order, allowing the suit to be reinstated, subject to the applicant paying costs to the respondent.

Court Disposition

Application allowed; dismissal order set aside; suit reinstated subject to payment of costs.

Orders

  • The order of June 16, 2021 dismissing the plaintiff's suit and consequential orders are set aside.
  • The applicant is at liberty to set down the suit for hearing upon full compliance with Order 11 of the Civil Procedure Rules.
