The court held that the plaintiff was not entitled to demand payment of auctioneer's fees as a precondition for executing the transfer and Land Control Board Consent documents. The plaintiff was directed to execute the documents unconditionally within seven days, failing which the Deputy Registrar would execute them. No order as to costs was made.
