Ratio Decidendi

The appeal was struck out as incompetent because the Appellant failed to extract and include the decree from the lower court judgment in the Record of Appeal, a mandatory requirement under Section 65(1) and Section 79G of the Civil Procedure Act and Order 42 Rule 13(4) of the Civil Procedure Rules. The omission of the decree is a substantive defect that cannot be cured by Article 159(2)(d) of the Constitution, as it goes to the root of the appellate process. Without the decree, the appeal is incomplete and the High Court lacks jurisdiction to entertain it. Consequently, the merits of the appeal regarding damages and liability were not considered.
