Procedural Posture

Environment and Land Appeal / Judgment

  1. 1 Whether the appellant obtained title to the suit property unlawfully.
  2. 2 Whether the 1st and 2nd respondents proved that Beth Muthoni Kabiru (deceased) was the lawful owner of the suit property.
  3. 3 Whether the trial court erred in allowing the respondents’ claim.

Ratio Decidendi

The court found that the appellant failed to prove lawful acquisition of the suit property, as the person who purportedly sold the land to him (the 3rd respondent) did not have good title, the original owner (Beth Muthoni Kabiru) was deceased at the time of the alleged transaction, and there was no evidence of a valid Land Control Board consent or proper transfer. The respondents established that their mother was the lawful owner, and the appellant's registration was tainted by fraud and illegality. The trial court was correct in ordering cancellation of the appellant's title and related subdivisions, as the root of his title was fatally defective. The appeal was dismissed for lack of merit.

Court Disposition

appeal dismissed

Orders

  • The appeal is dismissed with costs to the 1st and 2nd respondents.
  • The orders of the trial court, including cancellation of the appellant's title and related subdivisions, are upheld.
