The court found that the appeal was filed within the statutory period, as the last day for filing fell on a weekend and the memorandum of appeal was lodged electronically on the next working day. The applicants demonstrated a likelihood of substantial loss if stay was denied, as the respondents did not rebut the claim that they may be unable to refund the decretal sum if the appeal succeeded. The applicants had already deposited half the decretal sum as security.
