The court found that article 171(2)(d) of the Constitution clearly requires that the two representatives of judges and magistrates to the Judicial Service Commission be one woman and one man. Since the magistrate representative is currently a woman and her term has not expired, the vacancy for the judge's representative must be filled by a man. The impugned decision and rule 4.2 of the respondent’s election rules merely give effect to this constitutional requirement and do not violate the petitioner’s rights under articles 10, 27, 36, or 38.
