Procedural Posture

Criminal Revision / Ruling on Jurisdiction

  1. 1 Does the High Court have jurisdiction to review or revise its own decision after an appeal has been determined?
  2. 2 Is the applicant entitled to have the period spent in custody pending trial discounted from his sentence under section 333(2) of the Criminal Procedure Code?

Ratio Decidendi

The High Court lacks jurisdiction to review or revise its own decisions after it has determined an appeal. Once the High Court has heard and determined an appeal, any further challenge to its decision must be made to the Court of Appeal. The applicant's request to have the period spent in custody discounted from his sentence should have been raised during his appeal to the High Court. Since the High Court cannot supervise or reopen decisions of a court of equal jurisdiction, the application is incompetent for want of jurisdiction and must be struck out.
